In order to promote full and effective implementation of the MARITIME LABOUR CONVENTION, 2006 (MLC 2006), the P. R. China MSA issued the Implementation Plan for Promoting Sea-going Ships Engaged in Domestic Voyages and Ships below 500GT Engaged in International Voyages to Perform MLC 2006 (hereinafter referred to as “Implementation Plan”) recently.

 

The Implementation Plan set forth explicit provisions for propagation, implementation as well as arrangement for training and inspection. According to the Implementation Plan, from December 1, 2019 to January 31, 2020, all MSAs directly under P. R. China MSA shall, based on actual situation of performance for the MLC 2006 within their respective jurisdictions, formulate propagation, implementation and training plans, finishing propagation, implementation and training to management personnel of relevant companies in charge of convention performance within their respective jurisdictions; from February 1, 2020 to May 1, 2020, shipping companies shall finish self-check to their applicable ships on whether such ships are compliant with standards of MLC 2006; From May 1, 2020 to October 30, 2020, all MSAs directly under P. R. China MSA shall carry out inspections to applicable ships arriving at ports within their respective jurisdiction that have not been inspected from aspect of conditions in MLC 2006, and the proportion of inspection shall not be lower than 10% of number of arriving ships in previous month; from November 1, 2020 to November 12, 2021, these inspections shall be carried out with proportion no lowered than 30% in each month; as of November 13, 2021, all applicable arriving ships that have not been inspected shall be inspected for this regard; as to an applicable ship only navigating within jurisdictions of respective MSAs directly under P. R. China MSA, all MSAs directly under P. R. China MSA shall, before December 1, 2019, consult through marine labor relation three-party coordination mechanism to decide the commencement time/date for such inspection and formulate plans to implement inspection.

 

The Implementation Plan requires that all shipping companies shall correct any deficiency found during self-check, and shall report/submit the correction situation to the MSA directly under P. R. China MSA at the place where such shipping company locates or to the branch MSA designated by the MSA directly under P. R. China MSA; for a deficiency found by MSA, it shall, according to the Maritime Labour Conditions Inspection Business Process, require Master or shipping company of the ship to formulate correction measure and made correction within prescribed time; violation of law, regulations and rules will be disposed of in accordance with corresponding provisions.
